mPawa

Terms of Service

Effective 29 September 2026. mPawa is operated by Koda Digital Ltd (Kenya) and Koda Digital Inc (United States), together "Koda Digital", "we".

Plain-language summary. mPawa lets a family or group raise money for an occasion, collect messages from guests, and pay the money out. We charge a fee on money we move. You must be honest about what you are raising for. We do not hold your money ourselves; licensed payment providers do. This summary is not the contract; the sections below are.

1. Who can use mPawa

You must be 18 or older and able to enter a contract. By creating an account or contributing you agree to these terms and to our Privacy Policy.

2. Campaigns

An organiser creates a campaign for a real purpose: a wedding, a funeral, a hospital bill, school fees, a trip, or a similar personal cause. The organiser is responsible for the accuracy of the campaign, for how the money is used, and for the people they invite. mPawa is not a charity and campaigns are not tax-deductible unless the organiser tells you otherwise and can prove it.

We may pause or close a campaign that looks fraudulent, that raises for something illegal, or that receives credible reports. We will tell the organiser why.

3. Contributions

A contribution is a gift to the campaign's organiser or beneficiary, not a purchase from mPawa. Once a contribution has cleared it is generally not refundable by mPawa; contact the organiser. Where a payment provider reverses a card payment, the reversed amount is deducted from the campaign.

4. Fees

M-Pesa contributions: mPawa keeps 2.5% of each payout. Card contributions: the card processor's fee is passed through and mPawa keeps 2%. The amount the family receives is shown before you pay. Fees can change; the current fees are always shown in the app before a payment.

5. Payouts and money handling

Money raised in Kenya is collected and paid out by Koda Digital Ltd through Safaricom (M-Pesa) and Paystack. Money for campaigns paid out in the United States is collected and paid by Stripe under an account the organiser opens with Stripe. mPawa does not hold funds itself. Payouts go to the organiser's nominated M-Pesa number or bank account. Organisers are responsible for any tax on money they receive.

6. Guest book and group chat

Messages you post are visible to the campaign's group and, for the guest book, to anyone with the campaign's link. Do not post anything unlawful, abusive, or that you do not have the right to share. Organisers can hide or delete messages. Every message can be reported, and you can block another member. We may remove content and suspend accounts that break these rules.

7. Your account

Keep your phone number secure; sign-in codes are sent to it. You can delete your account in the app under Profile, or by asking us at [email protected]. An organiser must close open campaigns before deleting an account so that raised money can still be paid out.

8. What we are not responsible for

We provide mPawa as it is. We are not responsible for how an organiser uses money, for a payment provider's outage, or for losses that we could not reasonably foresee. Nothing in these terms limits liability that cannot be limited by law.

9. Changes and contact

We may update these terms; the effective date above changes when we do, and material changes are announced in the app. Questions: [email protected].

Governing law: Kenya for the Kenyan entity's services; Delaware, United States for the US entity's services. This document is a draft prepared for legal review before launch.
